Quick answer

Why does Revenue NSW require a stamp duty valuation?

Transfer duty in NSW is assessed on the greater of the consideration paid or the unencumbered market value of the property. When parties are not at arm's length, Revenue NSW may require an independent valuation to confirm market value.

  • Transfers between family members, spouses or de facto partners.
  • Moving property into or out of a family or discretionary trust.
  • In-specie contributions of property to an SMSF.
  • Company restructures and transfers for nil or nominal consideration.

Section 106 and Revenue NSW compliance

Revenue NSW has the power to request a valuation where the dutiable value may exceed the stated consideration. Our reports are prepared specifically to satisfy these requirements, stating market value at the date of the dutiable transaction with full supporting evidence.

Why contract prices are rejected

Where a contract price is below market value between related parties, Revenue NSW will assess duty on market value instead. An independent valuation obtained upfront avoids reassessment notices, interest and delays at settlement.
